In-Person Classes
1. Interpretation & Variation:
1.1 In these Terms of Use the following definitions apply: “Company” means Barre Where You Are LLC . “Client" means any person that has completed and submitted the online registration form (the “Sign Up Form”) at the Barre Where You Are website, http://www.barrewhereyouaresc.com and whose registration has been accepted by the Company. “Terms and Conditions” means these terms and conditions.
1.2 References in the Terms and Conditions and Terms of Use to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.
1.3 These Terms of Use are incorporated into the Sign Up Form.
1.4 The Company reserves the right to vary and revoke the Terms and Use and the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Company and the conduct of Clients. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.
2. clients:
2.1 Subject to the Terms and Conditions and Terms of Use when a person has completed the Sign Up Form she will become a Client of the Company.
2.2 Acceptance of a person as a Client is in the absolute discretion of the Company.
2.3 The Company reserves the right to suspend for a specific period or refuse to renew the Membership of any Client whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Company or which amounts to a breach of the Terms and Conditions or Terms of Use where such expulsion is otherwise in the interests of the other Clients. Any Client so expelled will forthwith cease to be a Client of the Company and will not be entitled to any refund for any period during which her membership is suspended.
2.4 Clients must be 18 or over.
3. Payment terms:
3.1 Details of class and other services prices are available by emailing barrewhereyouare@gmail.com.
3.2 A Client may not attend any class without first booking and paying for the relevant class or session.
3.3 Payments in any amount are non-refundable unless otherwise stated in the Terms and Conditions.
3.5 Clients must keep an active credit or debit card on file.
4. your fitness & health:
4.1 By agreeing to the Terms of Use and Terms and Conditions Clients hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulty); diabetes, epilepsy or any allergy) which may affect their participation in any class or online workout.
4.2 It is the Client’s sole responsibility to notify the Company before attending any class or private session of any circumstances affecting their health which may be exacerbated through continued use of the Company and/or which may have arisen or worsened since their last session with the Company (if any).
4.3 Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Client should consult her doctor.
4.4 The Instructor reserves the right to refuse access to any Client if, in their absolute discretion, it considers that the health of the individual concerned may be endangered.
4.5 Clients are required to follow the instructions of the instructor at all times.
5. limitation of liability:
5.1 The information available on or through this Site, and the Services supplied via or in connection with this Site do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor. It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this website (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by us to you. You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Barre Where You Are and its instructors for any injury or death caused by their negligence or other acts. 5.2 It is the Client’s responsibility to ensure that she is capable of undergoing a routine of exercises provided by any program which she follows or class which she attends. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by our instructors at no time constitutes medical advice in substitute for advice provided by a medical professional.
5.3 The Company accepts no liability for loss or damage to the property of Clients or for injury to Clients during class except insofar as such loss, damage or injury is by law incapable of exclusion.
5.4 In consideration of their participation in the activities and programs of the Company and the use of equipment owned and/or under the control of the Company the Client hereby waives and releases the Company from any and all responsibility or liability for injuries or damages resulting from their participation in any of the Company’s activities or use of the Company’s equipment save in respect of death or personal injury caused by the negligent act or omission of the Company.
6. dress:
6.1 Clients are requested to wear a form of dress appropriate to the practice of fitness activities and Barre Where You Are recommends that Clients wear stretch pants or shorts and a T-shirt or sports top.
7. safety & hygiene:
7.1 Smoking is forbidden in class.
8. general:
8.1 The Company may assign the benefit of the Sign Up Process and a Client’s membership to a third party at any time without notice to the Client.
8.2 The Company may, if a Client so wishes, communicate with the Client by electronic mail (“email”). By providing an email address to the Company the Client consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email.
8.3 Any marketing, educational or other materials of any nature whatsoever produced by the Company and which are made available to Clients will at all times remain the property of the Company and will be subject to the Company’s copyright.
8.4 Clients acknowledge that classes that may be physically strenuous are voluntarily participated in by them with full knowledge and that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

On-Line Classes
BY CLICKING “I ACCEPT,” OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS (TOGETHER, THESE “TERMS”). IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND BARRE WHERE YOU ARE LLC’s PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY BARRE WHERE YOU ARE LLC AND BY YOU TO BE BOUND BY THESE TERMS.
ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 12, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND BARRE WHERE YOU ARE LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. (See Section 12.)
Barre Where You Are LLC Service Overview. Through our Service you can stream LIVE barre classes (“LIVE Classes”) and on-demand workouts (“On Demand Workouts,” together with LIVE Classes, “Videos”) on your mobile device, tablet, computer or smart television. You can also purchase our branded merchandise (“Merchandise”).
Eligibility. The service is not for persons under the age of 13 or for any users previously suspended or removed from the service by Barre Where You Are LLC. If you are under 13 years of age, then you may not use or access the service at any time or in any manner without parental supervision. Furthermore, by using the Service, you affirm that either you are at least 18 years of age or have been authorized to use the Service by your parent or legal guardian who is at least 18 years of age and entered into these Terms on your behalf. If you are an entity, organization, or company, the individual accepting these Terms on your behalf represents and warrants that they have authority to bind you to these Terms and you agree to be bound by these Terms.
Accounts and Registration. To access the App, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, credit or debit card numbers and expiration dates and other payment information, or other contact information. If you sign up through the Website, you may be required to provide a credit or debit card numbers and expiration dates and other payment information. In addition, if you purchase Merchandise, you will be required to provide us with your shipping address. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. You are solely responsible for any losses or damages arising from use of your account and assume all liabilities arising from a third party’s use of your account information. If you believe that your account is no longer secure, then you must immediately notify us at barrewhereyouare@gmail.com.
General Payment Terms. You need to purchase a subscription to access and use the App for the period selected during the order process. Barre Where You Are LLC offers a 7-day free trial to the App. After the 7-day free trial, you will automatically be charged the monthly or yearly membership fee, depending on the subscription type you choose. Before you sign up for the free trial and pay any fees, you will have an opportunity to review and accept the fees that you will be charged. All fees are in U.S. Dollars and are non-refundable.
Price. Barre Where You Are LLC reserves the right to determine pricing for the Service. Barre Where You Are LLC will make reasonable efforts to keep pricing information published on the website up to date. We encourage you to check our website periodically for current pricing information. Barre Where You Are LLC may change the fees for any feature of the Service, including additional fees or charges, if Barre Where You Are LLC gives you advance notice of changes before they apply. Barre Where You Are LLC, at its sole discretion, may make promotional offers with different features and different pricing to any of Barre Where You Are LLC's customers. These promotional offers, unless made to you, will not apply to your offer or these Terms.
Authorization. You authorize Barre Where You Are LLC and its third-party payment processors to charge all sums for the orders that you make and type of subscription to the Service you select as described in these Terms or published by Barre Where You Are LLC, including all applicable taxes, to the payment method specified in your account. If you pay any fees with a credit card, Barre Where You Are LLC or its third party payment processors may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase.
Subscription Service. The Service includes automatically recurring payments for periodic charges (“Subscription Service”). If you activate a Subscription Service, you authorize Barre Where You Are LLC or its third party payment processors to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. The “Subscription Billing Date” is the date when you purchase your first subscription to the Service. For information on the “Subscription Fee,” please see our website. You agree that your account will be charged automatically on the Subscription Billing Date all applicable fees and taxes for the next subscription period. The subscription will continue unless and until you cancel your subscription or we terminate it. You must cancel your subscription before it renews in order to avoid billing of the next periodic Subscription Fee to your account. Barre Where You Are LLC or its third party payment processor will bill the periodic Subscription Fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information). You may cancel the Subscription Service through your account settings page or by contacting us at: barrewhereyouare@gmail.com.
Delinquent Accounts. Barre Where You Are LLC may suspend or terminate access to the Service, including fee-based portions of the Service, for any account for which any amount is due but unpaid. In addition to the amount due for the Service, a delinquent account will be charged with fees or charges that are incidental to any chargeback or collection of any then unpaid amount, including collection fees.
Intellectual Property Rights
Content. The content that Barre Where You Are LLC provides to users on or through the Service, including, without limitation, any Videos (including, without limitation, in sound recordings (and the musical works embodied therein) incorporated into the Videos (“Video Music”), or any other text, graphics, photos, software, interactive features or materials, are protected by copyright or other intellectual property rights and owned by Barre Where You Are LLC or its third-party licensors (collectively, the “Service Content”). Moreover, Barre Where You Are LLC solely owns all design rights, databases and compilation and other intellectual property rights in and to the Service, in each case whether registered or unregistered, and any related goodwill.
Marks. Barre Where You Are LLC trademarks, service marks and logos (“Barre Where You Are LLC Trademarks”) used and displayed on the Service are Barre Where You Are LLC’s registered and unregistered trademarks or service marks. Other product and service names located on the Service may be trademarks or service marks owned by third parties (“Third-Party Trademarks,” and, collectively with Barre Where You Are LLC Trademarks, the “Trademarks”). Except as otherwise permitted by law, you may not use the Trademarks to disparage Barre Where You Are LLC or the applicable third-party, Barre Where You Are LLC’s or a third-party’s products or services, or in any manner (using commercially reasonable judgment) that may damage any goodwill in the Trademarks. You may not use any Trademarks as part of a link to or from any service without Barre Where You Are LLC’s prior express written consent. All goodwill generated from the use of any Barre Where You Are LLC Trademark will inure solely to Barre Where You Are LLC’s benefit.
Licenses. Subject to your complete and ongoing compliance with these Terms, Barre Where You Are LLC hereby grants to you a non-exclusive and non-transferable license to do the following solely within the United States, its territories and possessions, for your personal, non-commercial use and during the term of these Terms: (1) access and use the Service in accordance with its permitted functionalities; (2) live-stream, or temporarily download and stream on-demand, Videos (and the Video Music therein), solely within the Service, provided that you may not access any Video (or Video Music therein) with more than one device at the same time; and (3) download and run the App on any device that you own or control in accordance with its permitted functionalities. Any third-party code that may be incorporated into the App is covered by the applicable open source or third-party license, if applicable.
Feedback. If you choose to provide us with input or suggestions regarding problems with or proposed modifications or improvements to any part of the Service (“Feedback”), then you hereby grant to us a perpetual, irrevocable, non-exclusive, fully-paid and royalty-free right to use and exploit the Feedback in any manner and for any purpose without any restriction, credit, attribution or fees due to you.
Reservation of Rights. All rights that we do not expressly grant in this Section 5 above we hereby reserve, and we do not grant any rights or licenses in these Terms by implication, estoppel, or otherwise. Further, you acknowledge and agree that Barre Where You Are LLC reserves the right to change, suspend or discontinue all or any part of the Service at any time without prior notice or liability.
License Restrictions. In addition to any other restrictions set forth in these Terms, and without limiting those restrictions, when using the Service, you may not (and not attempt to or assist any other person or entity in doing any of the following):
delete, alter or make unauthorized copies of any content made available on or through any part of the Service;
attempt to decipher, decompile, disassemble or reverse engineer any of the software or source code comprising or making up any part of the Service, except to the extent any such restrictions are expressly prohibited by applicable law;
rent, lease, loan, resell, sublicense, distribute or otherwise transfer any part of the Service or content thereon to any third party;
remove, circumvent, disable, damage or otherwise interfere with security-related features of any part of the Service, features that prevent or restrict use or copying of any content accessible on any part of the Service, or features that enforce limitations on use of any part of the Service or any content thereon;
delete any copyright or other proprietary rights notices on any part of the Service;
impersonate any person or entity, falsely claim an affiliation with any person or entity, or access accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity or content of information transmitted via the Service, or perform any other fraudulent activity;
gain unauthorized access to the Service, to other users’ accounts, names or personally identifiable information, or to other computers or websites connected or linked to the Service;
post any virus, worm, spyware or any other computer code, file or program that may or is intended to disable, overburden, impair, damage or hijack the operation of any hardware, software or telecommunications equipment or any other aspect of the Service or communications equipment and computers connected to the Service;
access, tamper or interfere with or disrupt the Service, networks or servers connected to the Service or violate the regulations, policies or procedures of those networks or servers; or
violate any applicable federal, state or local laws or regulations or the terms of these Terms.
User Content
User Content Generally. Certain features of the Service may permit users to upload content to the Service, including ratings and reviews (“User Content”) and to publish User Content on the Service. You retain any copyright and other proprietary rights that you may hold in the User Content that you post to the Service.
Limited License Grant to Barre Where You Are LLC. By providing User Content to or via the Service, you grant Barre Where You Are LLC a worldwide, non-exclusive, irrevocable, royalty-free, fully paid right and license (with the right to sublicense) to host, store, transfer, display, perform, reproduce, modify for the purpose of formatting for display, and distribute your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed.
User Content Representations and Warranties. Barre Where You Are LLC disclaims any and all liability in connection with User Content. You are solely responsible for your User Content and the consequences of providing User Content via the Service. By providing User Content via the Service, you affirm, represent, and warrant that:
you are the creator and owner of the User Content, or have the necessary licenses, rights, consents, and permissions to authorize Barre Where You Are LLC and users of the Service to use and distribute your User Content as necessary to exercise the licenses granted by you in this Section, in the manner contemplated by Barre Where You Are LLC, the Service, and these Terms;
your User Content, and the use of your User Content as contemplated by these Terms, does not and will not: (i) infringe, violate, or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; or (iii) cause Barre Where You Are LLC to violate any law or regulation; and
your User Content could not be deemed by a reasonable person to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate.
User Content Disclaimer. We are under no obligation to edit or control User Content that you or other users post or publish, and will not be in any way responsible or liable for User Content. Barre Where You Are LLC may, however, at any time and without prior notice, screen, remove, edit, or block any User Content that in our sole judgment violates these Terms or is otherwise objectionable. You understand that when using the Service you will be exposed to User Content from a variety of sources and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable. You agree to waive, and do waive, any legal or equitable right or remedy you have or may have against Barre Where You Are LLC with respect to User Content. If notified by a user or content owner that User Content allegedly does not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to remove the User Content, which we reserve the right to do at any time and without notice. For clarity, Barre Where You Are LLC does not permit copyright-infringing activities on the Service.
Monitoring Content. Barre Where You Are LLC does not control and does not have any obligation to monitor: (a) User Content; (b) any content made available by third parties; or (c) the use of the Service by its users. You acknowledge and agree that Barre Where You Are LLC reserves the right to, and may from time to time, monitor any and all information transmitted or received through the Service for operational and other purposes. If at any time Barre Where You Are LLC chooses to monitor the content, Barre Where You Are LLC still assumes no responsibility or liability for content or any loss or damage incurred as a result of the use of content. During monitoring, information may be examined, recorded, copied, and used in accordance with our Privacy Policy.

INFORMATION WE COLLECT
We may collect a variety of information from or about you or your devices from various sources, as described below.
Information You Provide to Us.
Registration and Profile Information. When you register to use our Service, we ask for your name, email address, and password.
Communications. You may receive emails with Barre Where You Are-related news and information to the email address you provided as part of the registration process. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt-out of receiving promotional messages from us, you will continue to receive administrative messages from us. If you contact us directly, we may receive additional information about you. For example, if you email our support team, we will receive information such as your name, email address, the contents of your message, any attachments you may send to us, and any other information you choose to provide.
Push Notifications. When you install our App on your mobile device, you agree to receive push notifications, which are messages an app sends you on your mobile device when the app is not on. These notifications include class reminders, forgotten password assistance, and account verification. You can turn off notifications by visiting your mobile device’s “settings” page.
Payment Information. You need to purchase a subscription to access and use the App for the period selected during the order process. If you purchase a subscription to our App, your payment-related information, such as your credit card or other financial information, is collected by our third-party payment processor on our behalf. This information will also be collected if you purchase merchandise through our online store at BarreWhereYouAreSC.com.
Survey Responses. We may ask you to respond to an optional survey to collect information about user interest. If you choose to respond to any survey, we will receive your responses to our questions and any other information you choose to share through the survey.
Information We Collect When You Use Our Service.
Information from Cookies and Similar Technologies. We and third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics partners, may use these technologies to collect information about your online activities over time and across different websites, apps, and other online Service. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Service.

We make reasonable efforts to protect your information by using safeguards designed to improve the security of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.
CHILDREN
We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at barrewhereyouare@gmail.com.
INTERNATIONAL TRANSFERS OF DATA
Our Service is hosted in the United States and intended for users located within the United States. If you choose to use our Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the Service.
